General Terms and Conditions of Sale

The use of the services or the purchase of products on www.kuny.es implies acceptance of these General Terms and Conditions of Sale (hereinafter, the “Terms”).

2. Acceptance and availability of the Terms

By accepting these Terms, the customer declares:

  • A) That they are of legal age and have the legal capacity to enter into a contract.
  • B) That they have read and accept these Terms.

These Terms govern the legal relationship arising from purchases made between users/customers and the online store www.kuny.es, owned by BYB WEAR 22 S.L.

The customer may save or print these Terms for future reference. In case of any questions, they may contact sales@kuny.es.

3. Amendments to the Terms

BYB WEAR 22 S.L may amend these Terms in order to improve the services and products offered on www.kuny.es. Such amendments shall be deemed notified upon publication on the website. In all cases, the Terms in force at the time the order is placed shall apply.

4. Purpose and scope

These Terms govern:

  • The purchase of products offered on www.kuny.es.
  • The payment, shipping, delivery and returns process.
  • The rights and obligations of the parties, being the customer and BYB WEAR 22 S.L.

The customer undertakes to provide truthful, up-to-date and complete information during the purchase process, especially regarding delivery and contact details.

5. Products, availability and presentation

The product offering on www.kuny.es may be amended, corrected or cancelled without prior notice.

The products displayed on the website are subject to availability. BYB WEAR 22 S.L may refrain from processing orders in the following cases:

  • Incomplete or incorrect information.
  • Product unavailability.
  • Reasonable suspicion of fraud.

6. Prices, taxes and shipping costs

All prices are shown in euros (EUR) and include the applicable VAT, unless expressly stated otherwise or in the event of a typographical error.

Shipping costs, where applicable, are shown during the purchase process before the order is confirmed, as indicated in the “Shipping and delivery” section.

7. Payment method and security

Payment for products and, where applicable, shipping costs may be made using the payment methods enabled on the website at any given time.

BYB WEAR 22 S.L adopts the necessary security measures to guarantee the confidentiality and security of payment details.

8. Purchase process and formation of the contract

To place an order on www.kuny.es, the user must:

  1. Select the products and add them to the cart.
  2. Complete the requested information.
  3. Review the order summary, including products, amounts, taxes and shipping.
  4. Confirm the order and make payment.

Once the purchase has been completed, the customer will receive a confirmation email with the details of the transaction.

9. Shipping and delivery

9.1. Order processing

Orders are processed from Monday to Friday, between 9:00 a.m. and 2:00 p.m.. Orders placed on Friday will be processed on the next business day, being Monday.

9.2. Delivery times

Spain (mainland), the Balearic Islands and Portugal (mainland):
Estimated delivery time: 48 to 72 hours.

9.3. Shipping costs and delivery areas

Spain

  • Standard shipping: EUR 5.
  • For orders over EUR 150, shipping will be free.

European Union countries

We ship to: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia and Sweden.

  • Standard shipping: EUR 8.
  • For orders over EUR 150, shipping will be free in the countries listed above.

10. Exchanges, returns and refunds

10.1. Time limit

The customer has 14 calendar days from receipt of the order to request a return.

10.2. Conditions for accepting a return

For a return to be accepted, the product must:

  • Be unused and in perfect condition.
  • Be returned in its original packaging and properly protected.
  • Include all original accessories or items.

10.3. Return options (GLS)

To request a return, please access our returns portal and enter your order details.

You will be able to indicate the reason for your return and, once you enter your location, you will see the GLS Parcel Shops available near you. Choose the one that is most convenient for you and a QR code will be generated.

Simply take your properly prepared parcel to the selected GLS Parcel Shop and show the QR code to send it.

10.4. Refund

Once the goods have been received and their condition has been verified, the refund will be issued using the same payment method used for the purchase.

  • Usual refund processing time: 3 to 7 business days, depending on the bank.
  • Original shipping costs are non-refundable, except in the event of a defective product or an error attributable to BYB WEAR 22 S.L.

11. Right of withdrawal

In accordance with applicable consumer regulations, the customer has 14 calendar days from receipt of the order to withdraw from the contract without having to provide any justification.

To exercise this right, the customer must notify us in writing at:

Suggested template, not mandatory:

“I hereby notify you that I withdraw from my sales contract for the following goods/service (specify product and reference), ordered on (date) and received on (date), full name, address, signature where applicable, and date.”

The refund will be made within a maximum period of 14 calendar days from notification of the withdrawal. It may be withheld until the goods are received or proof of return is provided.

12. Liability

BYB WEAR 22 S.L's liability for the products supplied is limited to their value, except where otherwise required by law.

BYB WEAR 22 S.L shall not be liable for service interruptions caused by force majeure, external technical incidents or causes not attributable to the company.

13. Intellectual and industrial property

All content on www.kuny.es, including texts, images, design, logos, trademarks and other elements, is protected by intellectual and industrial property rights and is owned by BYB WEAR 22 S.L or authorised third parties.

Its reproduction, distribution or public communication is prohibited without prior written authorisation.

14. Data protection

The personal data provided during the purchase process will be processed in accordance with applicable regulations and the Privacy Policy of www.kuny.es.

The customer may exercise their rights of access, rectification, erasure, objection, restriction and data portability by contacting sales@kuny.es.

15. Applicable law and jurisdiction

These General Terms and Conditions are governed by Spanish law.

In the event of a dispute, the parties submit to the courts and tribunals having jurisdiction in accordance with consumer and user regulations.

Notices sent by the customer to the indicated addresses shall be deemed valid for management and customer service purposes.

17. Partial invalidity

If any clause of these Terms is declared null, invalid or unenforceable, such invalidity shall not affect the remaining provisions, which shall remain fully in force.
